Official Rules
NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID OUTSIDE THE 50 UNITED STATES, DISTRICT OF COLUMBIA, AND WHERE PROHIBITED OR RESTRICTED BY LAW.

OVERVIEW:
We created the Attune Foods Healthy Holidays Recipe Contest (“Contest”) to encourage and find out how you might bake or cook with cereals and graham crackers as healthier alternatives during kitchen-intensive months of October-December.
 

ELIGIBILITY:
Participation is open to legal residents of the 50 United States and the District of Columbia, must be at least the age of majority in state of residence at the time of entry. Employees, officers, directors, agents, representatives, brand ambassadors, and any of their family members or persons living in the same household of Attune Foods, Inc. (the "Sponsor") and its affiliates, subsidiaries, law firms, contest judges, advertising and promotion agencies, and anyone connected with the conduct of this Contest are ineligible to participate. The Contest consists of four contest categories: Healthy Treats, Pie, Gluten-Free, and Vegan; limit one entry per contest category per person and e-mail address. If more than one entry is received per person or e-mail address for any category, only the first entry received will be considered.

DATES:
The Contest begins at 8 a.m. Pacific Time (“PT”) on 10/01/2012, and ends at 5:00 p.m. PT on 12/31/2012 (“Contest Period”). All Entries must be received by Monday, December 31, 2012 at 5:00 p.m. PT.

HOW TO ENTER:
Enter the Contest online by submitting an original Entry through the entry form on the Contest web page, http://www.attunefoods.com/recipe-contest. All Entries become the property of the Sponsor and none will be returned.
 
 
 
All Entries must meet the following general criteria:
o Must be original, cannot have been previously published or posted, and cannot have previously won any prizes or awards.
o Must identify recipe name
o Must include complete list of ingredients with exact quantities in the order they are used
o Must include five ingredients or more.
o Must include complete instructions on preparing the recipe along with cooking time, temperature and description of cookware.
o Can include photo of dish (but photo will not be judged). Photos may not depict any individuals but should feature the finished dish from the recipe being entered.
o Must not reference any company other than Sponsor or any trademarks, service marks, logos, or brands other than the Attune Foods marks and products.
o Must not violate, misappropriate or infringe any third party’s intellectual property, proprietary, or other rights.
Entries for each contest category must meet the following additional criteria:
 
• HEALTHY TREATS
o Must be an original treat recipe.
o Must incorporate one of the following Attune Foods products into the recipe: Uncle Sam Original cereal, Uncle Sam Skinner’s Raisin Bran or Erewhon Organic Raisin Bran.
 
• PIE
o Must be an original graham cracker crust pie recipe.
o Must incorporate one of the following Attune Foods products into the recipe: Erewhon Organic Honey Graham Crackers or Erewhon Organic Cinnamon Graham Crackers.
 
• GLUTEN-FREE
o Must be an original savory or sweet gluten-free recipe.
o Must incorporate one of the following Attune Foods products into the recipe: Erewhon Crispy Brown Rice- Gluten Free or Erewhon Corn Flakes.
 
• VEGAN
o Must be an original savory or sweet vegan recipe.
o Must incorporate one of the following Attune Foods products into the recipe: Erewhon Buckwheat & Hemp cereal or Erewhon Crispy Brown Rice- Gluten Free.

Sponsor reserves the right, in its sole discretion, to reject any Entry that it deems inappropriate, unlawful, objectionable, or offensive, or otherwise in violation of these Official Rules. Entries that are determined to be copies of other entries submitted in the Contest or plagiarized from other websites and/or publications will be void and disqualified.

USE OF ENTRIES AND ENTRANT INFORMATION:
Each entrant irrevocably transfers and assigns to Sponsor his/her Entry and all rights, title, and interest therein and thereto (including intellectual property rights). Entrants acknowledge that Sponsor and its agents and representatives may use, edit, publish, display, copy, sublicense, transmit, distribute, reproduce, publicly perform, create derivative works based on, or incorporate into other works, the Entry or any portion, in any form, manner, or media, and for any commercial or non-commercial purpose (including, without limitation, marketing or promotional purposes), without notice to, approval by, or compensation to entrant. Each entrant agrees that the results and proceeds of such use shall become the sole property of Sponsor, and shall be freely assignable by Sponsor.
 
By participating in the Contest, each entrant hereby grants permission for Sponsor and its agents and representatives to use entrant's name, likeness, city and/or state of residence, photograph and/or image for any purpose, without further notice, permission, compensation or consideration in any and all media now known or hereafter developed, unless prohibited by law. By entering, each entrant represents and warrants that he/she has all necessary right, power and authority to submit the Entry and grant the rights to Sponsor set forth herein, and will take any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by Sponsor to effect, perfect or confirm the rights granted.

JUDGING AND ANNOUNCING WINNERS:
For each of the four (4) contest categories, from among all eligible recipe submissions received for that particular category, an independent judge will select one (1) winning recipe based on the following criteria (photos submitted as part of an Entry will not be judged): originality (25%), adherence to the theme (25%), appearance (25%), and taste (25%).
We will announce the winner for each contest category on the Attune Foods Daily Digest blog, http://blog.attunefoods.com on or about January 11, 2013.

Odds of winning each contest category prize will depend on the total number of eligible entries received. Decisions of the judge will be final and binding on all matters.

Prior to announcing any winners on the blog, potential winners will be notified via e-mail. Prize awards are subject to verification. Potential winners may be required to sign an affidavit of eligibility and liability release, publicity release, and IRS Form W-9 (where permitted or required). Any prize may, in Sponsor’s discretion, be awarded to an alternate winner if an affidavit, release(s), and/or Form W-9 is/are incomplete or not returned within 3 business days after being sent to a winner, if a prize notification or prize is returned as undeliverable, or if Sponsor cannot notify any potential winner for any reason.
 
PRIZES:

Each contest category will have one (1) winner.
Each contest category has a specific prize assigned to it:

HEALTHY TREATS: Breville Food Processor and 6 months of one flavor of winner-selected cereal (12 boxes all sent at one time). Total approximate value of prize being awarded is $359.

PIE: KitchenAid Stand Mixer and 6 months of one flavor of winner-selected cereal (12 boxes all sent at one time). Total approximate value of prize being awarded is $310.

GLUTEN-FREE: Circulon 11-piece Chocolate Set and 6 months of one flavor of winner-selected cereal (12 boxes all sent at one time). Total approximate value of prize being awarded is $359.

VEGAN: Wusthof 7-piece knife set and 6 months of one flavor of winner-selected cereal (12 boxes all sent at one time). Total approximate value of prize being awarded is $359.
 
OTHER TERMS & CONDITIONS:
Incomplete entries will be void. Sponsor reserves the right to substitute prizes of equal or greater value. No other transfer, substitution, or exchange of prize offered will be allowed, except at the sole discretion of the Sponsor. Winners and all entrants agree that the Sponsor and its affiliates, subsidiaries, judges, prize suppliers, agencies, vendors, officers, directors, agents, representatives and employees shall not be liable for, and entrants release them from, any injury, liability, claim, loss, damage, cost or expense of any kind arising out of or relating to any entrant’s participation in this Contest or from the acceptance or use of any prize awarded. PRIZES ARE AWARDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE), EXCEPT THAT A PRIZE WILL BE SUBJECT TO ITS MANUFACTURER'S WARRANTY (IF ANY). Taxes on prize, if applicable, are the winner's responsibility. All federal, state, provincial, and local laws and regulations apply. Each entrant shall indemnify and hold harmless Sponsor and its affiliates, subsidiaries, judges, agencies, vendors, officers, directors, agents, representatives and employees from and against any and all liability for any claims, actions, judgments, demands, damages, losses, liabilities, costs and expenses of any kind arising out of or relating to their use of an Entry or the entrant’s use, misuse, or possession of any prize. Entries that and/or entrants who fail to adhere to these Official Rules, provide information that is inaccurate or fraudulent, or attempt to disrupt the Contest or circumvent these Official Rules may not be considered and/or may be disqualified, in Sponsor’s sole discretion. Sponsor reserves the right to cancel or modify the Contest if, in Sponsor's sole determination, it believes that the integrity of the Contest has been, or could be compromised or that the Contest is not capable of running as planned for any reason, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, acts of God, terrorism, or threats thereof, or any other causes. In no event will Sponsor or its affiliates, subsidiaries, agencies, law firms, or any of their employees, officers, directors, agents, or representatives be responsible or liable for: (a) any late, lost, misrouted, illegible, garbled, distorted, damaged, or postage due transmissions, e-mail, or mail; (b) telephone, electronic, hardware, software, network, Internet, other computer- or communications-related malfunctions or failures, or other errors, omissions, interruptions or problems that may limit or affect an individual’s ability to participate in the Contest or receive any communications or materials relating to the Contest; (c) any disruptions, injuries, losses or damages in any way arising out of or relating to participation in the Contest or the use, misuse, or inability to use any prize, or (d) any printing or typographical errors in any materials associated with the Contest. ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
